Terms of Service

1. Acceptance of Terms

By accessing or using Ghostko ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Ghostko is a comprehensive TikTok growth platform that provides:

  • Advanced Analytics: In-depth TikTok video performance tracking, audience insights, engagement metrics, and growth analytics.
  • AI Content Planning: AI-powered content idea generation, video scripts, and content strategies based on topics or existing videos.
  • AI Rebuffer: AI service to analyze viral content and recreate similar video concepts.
  • Inspiration Feed: Curated feed of trending TikTok content for inspiration.
  • Content Management: Save videos, plan content, and organize your content strategy.

3. Account Registration

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must not share your account credentials with others.
  • You must notify us immediately of any unauthorized access to your account.

4. TikTok Account Connection

By connecting your TikTok account to Ghostko via OAuth, you authorize us to access your TikTok account data, video metrics, profile information, and analytics as necessary to provide the Service. You represent that:

  • You have the authority to grant this access to your TikTok account.
  • Your use of our Service complies with TikTok's Terms of Service.
  • You will not use the Service to violate TikTok's Community Guidelines.
  • You may connect up to 5 TikTok accounts under the Pro subscription.

5. Subscription and Billing

Ghostko offers a Pro subscription plan with the following terms:

  • Pricing: $39.99 per month, billed monthly.
  • Free Trial: New users receive a 3-day free trial. You will not be charged during the trial period. After the trial ends, your subscription will automatically begin and you will be charged the monthly fee.
  • Auto-Renewal: Your subscription automatically renews each month unless cancelled.
  • Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.
  • Refunds: We do not offer refunds for partial months or unused credits. If you cancel during your trial period, you will not be charged.
  • Payment Processing: Payments are processed securely through Lemon Squeezy, our payment provider.

6. AI Credits System

Active Pro subscribers receive monthly AI credits:

  • Monthly Allocation: 1,000 AI credits per month, renewed on your billing date.
  • Credit Costs: AI Rebuffer (25 credits), AI Plan from Topic (15 credits), AI Plan from Video (25 credits).
  • No Rollover: Unused credits do not carry over to the next month.
  • Subscription Required: AI credits are only available to active Pro subscribers. Credits stop renewing if your subscription is cancelled or expires.
  • No Refunds: Credits have no cash value and cannot be refunded or transferred.

7. Acceptable Use

You agree not to use the Service to:

  • Generate, save, or plan spam, deceptive, misleading, or harmful content.
  • Violate any applicable laws, regulations, or third-party rights.
  • Impersonate others or misrepresent your affiliation with any entity.
  • Violate TikTok's Terms of Service or Community Guidelines.
  • Manipulate, falsify, or misrepresent analytics data.
  • Use the Service to harass, abuse, or harm others.
  • Attempt to reverse-engineer, decompile, or hack the Service.
  • Use automated scripts or bots to access the Service.
  • Resell, redistribute, or sublicense the Service to third parties.
  • Abuse the AI services to generate excessive or inappropriate content.
  • Engage in any activity that could harm, disrupt, or overload the Service.

8. AI-Generated Content

Our AI services generate content suggestions based on your inputs. You acknowledge that:

  • AI-generated content is provided as suggestions only and may not be accurate, complete, or suitable for your purposes.
  • You are solely responsible for reviewing, editing, and approving all AI-generated content before use.
  • We do not guarantee the quality, originality, or effectiveness of AI-generated content.
  • You must ensure AI-generated content complies with all applicable laws and platform guidelines.
  • We are not liable for any consequences of using AI-generated content.

9. Content Responsibility

You are solely responsible for all content you create, save, plan, or publish in connection with the Service. You represent and warrant that your content:

  • Does not violate any laws, regulations, or third-party rights.
  • Complies with TikTok's Community Guidelines and Terms of Service.
  • Does not contain hate speech, harassment, threats, or harmful content.
  • Does not infringe on any intellectual property rights.
  • Does not contain false, misleading, or deceptive information.

We do not review, approve, or endorse user content. We reserve the right to remove content or suspend accounts that violate these terms.

10. Service Availability and Limitations

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time. We are not liable for:

  • Service downtime, interruptions, or unavailability.
  • Analytics discrepancies or data delays.
  • AI service errors, inaccuracies, or unavailability.
  • Changes to TikTok's API that affect our Service.
  • Loss of saved content, planned posts, or AI-generated content.
  • Any circumstances beyond our reasonable control.

11. Intellectual Property

The Service, including its design, features, branding, and original content, is owned by Ghostko and protected by intellectual property laws. You may not:

  • Copy, modify, distribute, or reverse-engineer any part of the Service.
  • Use our trademarks, logos, or branding without written permission.
  • Extract or scrape data from the Service using automated tools.
  • Create derivative works based on the Service.

You retain all rights to content you create or upload. By using the Service, you grant us a license to use your content solely to provide and improve the Service.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will meet your requirements, be error-free, secure, or uninterrupted. We do not warrant the accuracy, reliability, or completeness of any analytics data, AI-generated content, or other information provided through the Service.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

  • Your use of or inability to use the Service.
  • Any AI-generated content or suggestions.
  • Analytics data inaccuracies or discrepancies.
  • Unauthorized access to your account or data.
  • Service interruptions, errors, or bugs.
  • Content created, saved, or planned through the Service.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

14. Indemnification

You agree to indemnify and hold harmless Ghostko, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your content or AI-generated content you use.
  • Your violation of any laws or third-party rights.

15. Termination

We may suspend or terminate your account at our discretion if you violate these terms, abuse the Service, or engage in prohibited activities. You may cancel your account at any time through the settings page.

Upon termination:

  • Your right to use the Service ceases immediately.
  • Your subscription and AI credits are forfeited.
  • We may delete your data in accordance with our Privacy Policy.
  • No refunds will be provided for the remaining subscription period.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

17. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

18. Miscellaneous

  • Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Ghostko.
  • No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
